Please read these Terms of Service carefully before using our Service.
1. Interpretation and Definitions
1.1 Interpretation
The words with capitalized initial letters used in these Terms have the meanings defined in the following section. These definitions apply regardless of whether they appear in singular or plural form.
1.2 Definitions
- Application refers to the software "GetImagify" provided by the Company, accessed via any electronic device.
- Account refers to an individual account created for accessing the Service.
- Company (also referred to as "We", "Us" or "Our") refers to MPH GL GmbH, Panoramaweg 1, 8274 Tägerwilen, Switzerland.
- Service refers to the provision of the "GetImagify" application.
- Subscription refers to services or access to the Service offered by the Company on a subscription basis.
- Payment Provider refers to Paddle, which acts as Merchant of Record and handles payment processing for subscription purchases.
- You refers to the individual or legal entity accessing or using the Service.
2. Payment Processing and Pricing
2.1 Payment Processing
All payments for the Service are processed exclusively through our payment provider Paddle. Paddle acts as Merchant of Record and is responsible for billing and tax handling.
When purchasing a subscription through the Service, you agree to Paddle's Terms of Service and Privacy Policy. More information can be found here: Paddle Terms.
The Company does not store or process any payment information. All transactions are processed securely through Paddle.
2.2 Price Changes
We reserve the right to change our prices at any time.
If a price change occurs, you will be notified at least 30 days in advance via email or through the Service.
If you do not agree with the price adjustment, you can cancel your subscription until the day the change takes effect and receive a prorated refund for the remaining period.
3. Managing Your Subscription
3.1 Subscription Management
You can manage your subscription through your account settings in GetImagify. Billing cycles are processed automatically through Paddle. Usage limits apply based on your selected plan.
3.2 Plan Upgrades or Changes
You can upgrade or downgrade your subscription at any time through the settings in GetImagify. Plan changes take effect immediately, with prorated billing adjustments.
3.3 Cancellation and Account Deletion
You can cancel your subscription at any time. Your current plan remains active until the end of the billing period. Complete deletion of your account is possible through Settings > Account Settings. This process is irreversible. Already paid amounts are not refunded.
3.4 Consequences of Unpaid Invoices
If an invoice is not paid within the payment deadline, you will receive a payment reminder after 7 days. If the invoice remains unpaid for another 14 days, your account will be suspended. During suspension, you have no access to the Service. The suspension remains until the outstanding invoice is fully paid.
4. Data Privacy, Backups and Availability
4.1 Data Privacy and GDPR Compliance
We process personal data in accordance with GDPR. More information can be found in our Privacy Policy.
4.2 Data Retention and Backups
We create regular encrypted backups of your data. These backups are stored for 30 days and then irreversibly deleted. You are responsible for regularly exporting your data. This applies especially before deleting your account, as recovery is not possible.
4.3 Service Availability
We strive for high availability of the Service but cannot guarantee uninterrupted use. Maintenance work is announced in advance, usually on Sundays. There is no compensation for data loss or downtimes.
5. AI Processing and Content
5.1 AI Features
GetImagify uses AI services (OpenAI) to process your requests. Your prompts and generated content are processed according to our Privacy Policy. You retain ownership of content you create using our Service.
5.2 Content Responsibility
You are responsible for the content you create and process through our Service. You must not use the Service for illegal or harmful purposes. We reserve the right to suspend accounts that violate these terms.
6. Emails and Newsletters
6.1 Transactional Emails
We send transactional emails such as confirmations, notifications, or security-related communications. These emails cannot be disabled, but their content can be partially configured.
6.2 Newsletters
We reserve the right to occasionally send you newsletters with information about GetImagify. You can unsubscribe at any time via an unsubscribe link in each email.
7. Limitation of Liability and Final Provisions
We assume no liability for damages arising from the use or unavailability of the Service. We provide no guarantee for error-free or uninterrupted use of the Service. Changes to these Terms will be announced at least 30 days in advance. If you do not agree, you can cancel your subscription and receive a prorated refund. These Terms are governed by Swiss law, and disputes are to be resolved in Switzerland.
